1) Who we are

Personal Chef Vienna ("PCV", "we", "us") is operated by Chelsea Frischknecht & Tobias Maier, Heiligenstadter Strasse 144, 1190 Wien, Austria.

2) Scope & Definitions

These Terms apply to all services we provide to consumers  in Austria, including (i) Weekly Meal Service subscriptions, (ii) Gifting Meals, and (iii) pop‑up events / special catering (together, the "Services"). "Delivery Week" means the week in which the subscription meals are delivered.

3) Service Description

  • Weekly Meal Service. A rotating weekly menu of five freshly prepared dishes, cooked from scratch in small batches, packed with reheating instructions. Plans: Single (5 dishes, portioned for one person), Double (5 dishes / two people), Family (custom).

  • Gifting Meals. Prepaid meal packages delivered to the recipient, with an e‑gift card and coordination of delivery timing.

  • Pop‑Ups / Special Catering. Occasional fixed‑date events, take‑away menus, or bespoke small catering.

4) Menu Options & Allergens

  • Menu packages: Omnivore, Vegetarian / Pescatarian, Low‑Carb.

  • Our subscription is best suited to customers without severe allergies and who consider themselves non‑picky eaters. If you have specific dietary restrictions, please contact us before booking so we can confirm feasibility.

  • We cook in a professional kitchen where common allergens are present. While we take care to avoid cross‑contact when requested, we cannot guarantee the complete absence of allergens.

  • The Client must disclose all allergies and dietary requirements. Personal Chef Vienna is not liable for adverse reactions caused by incomplete or incorrect information.

5) Prices (incl. VAT unless stated otherwise)

  • Weekly Meal Service (per week):

     Regular Delivery Plan: 

  • Single: €130

  • Double: €250

  • Family: Custom (quote provided)

Drop In Credit Plan: 

  • Single: €140

  • Double: €260

  • Family: Custom (quote provided)

  • Gifting Meals:

    • 3 meals (portioned for 2): €150

    • Each additional meal (portioned for 2): €45

6) Ordering, Scheduling & Trial

  • Trial: New Weekly Meal Service customers receive a 2‑week trial (standard “drop in credit” prices apply). Afterward, we agree to how you would like to proceed, and invoice only for booked weeks.

  • Scheduling: We contact you near month‑end to confirm your delivery dates for the following month. You can opt to book or skip weeks at that point. 

  • New Order Confirmations: A contract is considered concluded when the client places an order and Personal Chef Vienna confirms the order in writing (email, message, invoice, or website confirmation).

  • Regular Delivery Plan: Clients receiving the “regular delivery plan” automatically opt-in to order scheduling, and must declare if they prefer to opt-out for a given period of time. 

  • Drop In Credits: Are sold in packs of 4 credits, and must be used within a 3 month period from the purchase date. 

  • Menu preview & delivery window: Each Sunday, we share your weekly menu preview and a planned delivery window for the upcoming Tuesday. 


7) Delivery & Pickup

  • Deliveries: Deliveries occur on Tuesdays from early afternoon onwards. Delivery windows are approximate, and may vary due to factors such as weather, traffic, etc. 

  • Access & handover: If someone is not available to receive the delivery, our couriers will leave the bag on the address doorstep as long as the building is accessible. Title to the goods passes upon handover; risk passes upon delivery to the address or agreed safe place.

  • Delivery Failure: If delivery fails due to incorrect address, no response, or client absence, the order is considered fulfilled and non-refundable. You are welcome to reach out to us via phone or email to reschedule the delivery. The second delivery will be charged at a rate of €15 per delivery within Vienna.  

  • Pickup: Only by prior arrangement, from our kitchen (Heiligenstadter Strasse 144, 1190) or an agreed upon location.

8) Packaging & Container Return

  • Packaging: Meals are provided in recyclable/compostable or reusable containers and delivered in a reusable cooler bag.

  • Container and bag return: Please rinse and return reusable containers and the cooler bag at your next delivery/pickup. An excess amount of lost, damaged, or unreturned items may be charged at replacement cost. 

9) Post‑Delivery Care & Food Safety

  • Chilling: Meals are delivered chilled. Refrigerate promptly after receipt. 

  • Use‑by & reheating: Consume within the indicated time. PCV is not liable for quality or safety issues arising after successful delivery due to improper storage or handling, delay in refrigeration, or reheating contrary to instructions.

  • Any complaints or missing items must be reported within 24 hours of delivery. Photos or descriptions may be requested to help us identify and fix the problem. 

10) Changes, Rescheduling & Cancellations (Weekly Meal Service)

  • Cancellations by the Client: We strive to be flexible to last-minute schedule changes, however we much also account for the costs of ingredient sourcing, preparation, and staff scheduling. As such, the cancellation periods are as follows: 

- More than 72 hours before delivery/service: 75% refund or full credit
- Between 48–72 hours: 50% refund or 70% credit
- Less than 48 hours: no refund

  • Non-response from Regular Delivery Clients: Clients receiving the regular delivery service are considered to automatically opt-in to order scheduling, and must declare if they prefer to opt-out for a given period of time. In case of non-response, Personal Chef Vienna will give a minimum of 2 written notices during the free-cancelation period, and 1 written notice within 72 hours prior to meal delivery. If no response has been given by 24 hours prior to delivery, the delivery will be canceled but the full fee charged.

  • Late‑notice add‑ins: You may request to add a portion or weekly delivery on short notice; we’ll try to accommodate subject to capacity. No surcharge applies, but fulfillment is not guaranteed.

  • Permanent cancellation of the subscription: You may cancel at any time with effect from the end of the current billed month. Weeks already confirmed for the running month follow the rescheduling policy above.

10) Gifting Meals – Booking & Delivery

  • We will issue an e‑gift card once payment is confirmed. The recipient contacts us to choose their preferred delivery week (subject to Tuesday delivery slots). Gift credits are valid for 12 months from purchase.

11) Pop‑Ups & Special Catering

  • Event bookings may require a deposit and have their own cut‑off and cancellation terms. Please see the catering proposal for the specific cancellation terms of the offer.

12) Payment & Billing

  • Methods: Weekly Meal Service: bank transfer (IBAN) or PayPal. Invoices (incl. VAT) will be issued via email. 

  • International Payments: In the case of processing fees due to international transfers (eg. via Paypal), an additional transaction fee will be added to the invoice. 

  • Due date: Invoices are due within 14 days of issue and in any case before the relevant Tuesday delivery.

  • Late payment: We may suspend deliveries until payment is received.


    13) Right of Withdrawal

  • Many of our products are perishable and/or customized to personal needs. For such goods and for services tied to a specific date (e.g., event catering), the usual 14‑day withdrawal right does not apply.

  • Where the legal withdrawal right does apply, we will provide the model withdrawal form and process refunds as required by law. 

14) Warranty

Your statutory consumer rights apply. If something is not as ordered or is defective at delivery, please contact us promptly so we can make it right (replacement, price reduction, or refund where appropriate).

15) Liability

  • We are liable without limitation for personal injury and for damages caused by intent or gross negligence.

  • To the extent permitted by consumer law, our liability for slight negligence is limited to foreseeable, typical damages for the kind of contract and excludes indirect or consequential losses (e.g., loss of enjoyment, missed opportunities).

  • Product liability: Mandatory rights under the Austrian Product Liability Act remain unaffected and cannot be excluded.

16) Force Majeure & Safety

If events beyond our reasonable control (e.g., severe weather, supply shortages, kitchen/equipment failures, illness) impact our ability to cook or deliver, we will inform you and offer a substitute date, credit, or refund for the affected items.

18) Complaints & Customer Service

We want you to love the food. If something goes wrong, email hello@personalchefvienna.com with your name, delivery week, and a brief description (photos helpful). We aim to respond quickly and find a practical solution. Please note that taste and portion satiety are subjective, and not grounds for a refund. 

19) Data Protection

We process your data only to perform the Services, billing, and necessary communications. 

20) Final Provisions

  • Austrian law applies, excluding conflict‑of‑law rules; for consumers, any mandatory protections of your habitual residence remain.

  • If any clause is invalid, the remainder stays effective; an enforceable term closest to the original intent will apply.

  • The place of performance is Vienna. Disputes may be brought before the courts of your domicile or Vienna‑Innere Stadt, as provided by consumer law.
